There are no specific Ohio bereavement leave laws that require private employers to provide for bereavement leave. It is entirely optional on the employer’s part whether to provide for such benefit at all. The private employers also set the terms and conditions whether for how many days an employee allowed to be absent, whether it is paid or unpaid, whether to require documentation for verification, or to what extent in the employee’s degree of kinship is eligible.

State employees are covered by the Ohio Administrative Code which is promulgated by administrative agencies in the state of Ohio.
Under the Ohio Administrative Code, a full- or part- time permanent employee is entitled to three days’ paid bereavement leave upon the death of an immediate family member. Bereavement pay shall be based on the employee’s base rate.
